EU-patent på datorrelaterade uppfinningar : en rättsekonomisk analys

Computer programs must give a technical effect that goes beyond"normal physical interaction"to be considered to belong to a technical field. The invention shall be be susceptible of industrial application, which means that it should be possible to reproduce or use in any other industrial way. The reqirement that the invention shall be new means that the technique must not be previously known because of patents, published articles, etc. That an invention shall be a contribution to the state of the art in a technical field means that the invention shall not be obvious to invent for a person skilled in the art. Patents do effect the innovation among the inventers, but in most industries most inventions would be invented independent if there was a patent system or not.

Europeisk patenträtt i förändring

Efter många års kompromissande kommer ett Europeiskt patent med enhetlig verkan (EU-patent) att införas. Tillsammans med skapandet av en enhetlig domstol, kallad Unified Patent Court (UPC), kommer EU-patentet säkerställa en enhetlig patenträttslig tillämpning i alla deltagande länder. I denna uppsats görs först en genomgång av vad EU-patent respektive patent enligt The European Patent Convention (EPC-patent) innebär och hur tvister hanteras. Sedan förs en diskussion kring skillnaderna och deras påverkan på ett fiktivt företag inom bilsäkerhetsbranschen.EU-patentet kommer materiellt inte särskilja sig i någon större utsträckning från det nuvarande EPC-patentet. De stora skillnaderna kommer istället att vara den förenklade ansökningsprocessen, minskade kostnader och det geografiska skyddsomfånget.

Kvalitetssäkring av Patent- och registreringsverket : EPO-praxis som förebild för svensk handläggning av patent

Svensk patenträtt har i stor omfattning harmoniserats med praxis utvecklad av det europeiska patentverket (EPO), vad avser patenterbarhetskriterier. Anledningen till harmoniseringen har motiverats av att det ska bli en mer enhetlig bedömning av patent i Europa. Harmoniseringen har i vart fall inte innefattat så kallad formell praxis, som innefattar regler om hand­läggandet hos det svenska patentverket, i förhållande till handläggandet av det vid EPO. Vid Sveriges anslutning till European Patent Convention (EPC) år 1978, förespråkades att det svenska patentverket ansågs hålla en godtagbar standard i sin handläggning, men att det fram­tida förhållandet mellan svensk patenträtt och EPC kunde komma att innebära förändring om kvalitetsnivån inte kunde anses tillräcklig hög. Efter ett nyligen taget beslut av Patentbesvärsrätten (PBR) har Patent- och registreringsverkets (PRV) handläggning ifrågasatts, varför författarna valt att undersöka om en förändring av hand­läggningen vid PRV bör genomföras, i enlighet med det förslag som framställs i proposition 1977/78:1, med beaktande av praxis utvecklad av EPO. I uppsatsen redogörs för hur EPO har tydligare regler avseende patent­ärenden än vad PRV har, varför en harmonisering av detta område bör diskuteras för säkerställandet av hög kvalitet vid handläggningen hos det svenska patentverket. Det är författarnas uppfattning att en ofullständig harmonisering även av formella regler resulterar i ett problem för säkerställandet av rättssäkerheten, eftersom lagregleringen i Sverige kan anses bristfällig.

This dilemma consists of a wish (or obligation) to help those who need a refuge, and at the same time consider domestic issues such as financial costs and security problems. Thus, there are two perspectives which are important to consider when refugee policies are made. The aim of this paper is to see which perspective the EU had when making their migration policies. The question asked is: which perspective is behind the making of European refugee policy?The theories realism and idealism are used to describe the conflicts in the making of European refugee policies.

The starting point was a review of the European Court practice, domestic Swedish practice and relevant literature.The outcome of the review is that the remedies available to the individual?s disposal can be divided into two categories: primary and secondary remedies. Primary remedies mean compensation not consisting of money, and must be exhausted first.

In 1972 the regulations on tax surcharge were introduced. In the new system the sur-charge are imposed by the Tax Authority (skatteverket) and not the Court. Since 1995 the European Convention on Human Rights constitute law in Sweden, which means that Sweden is forced to guarantee its citizens the human rights in the Convention. Article 6 in the Convention states that everyone, in the determination of his civil rights and obligations or of any criminal charge against him, is entitled to a fair hea-ring within reasonable time. The Article also expresses the right for anyone charged with a criminal offence to be presumed innocent until proved guilty according to law (the presumtion of innocence).

Inom EU så finns det två alternativa patent som innovatörer kan välja emellan, det europeiska och nationella patentet. Europeiska patent har visat sig inte vara tillräckligt rättssäkra och ekonomiskt överkomliga. Det beror på den risk som finns med flera patenttvister och motsägelsefulla domar.Det är därför som EU vill skapa en inre marknad för patent på EU-nivå. En ny diskussion kring religionsfriheten : Alternativ till religionsfrihetsbegreppet under Europakonventionen och Europeiska domstolen för de mänskliga rättigheterna

Freedom of religion or belief is indisputable in Human rights discourse, more discussed is exactly what it is that is included in the concept of freedom of religion or belief (in Swedish: religionsfrihet). This thesis focuses on the freedom of religion or belief in a European context, in particular on the European court of human rights and article 9 in the European convention for human rights. Some criticism has been directed against the Court to the effect that its practice and verdicts don't answer to the pronounced desire to develop a pluralistic and inclusive form of freedom of religion or belief.My aim is to examine, analyse and test three different theories, which all try to develop alternatives to the expression freedom of religion or belief, in relation to six verdicts from article 9 in Europe convention. My basic purpose is to try to find new ways of talking about freedom of religion or belief that might lead to a more inclusive, pluralistic and equal interpretation of that concept.The three theories wich I use are elaborated by Richard Amesbury (associate professor at Claremont school of Theology); Hugo Strandberg (TD at Åbo Akademi) and Eberhard Herrmann (professor in philosophy of religion at Uppsala University); and Martha Nussbaum (professor of law and ethics at the University of Chicago).
